CRIMINAL APPEALS

Most criminal defense lawyers only have experience handling cases in trial courts. These “trial” lawyers do not devote their time to studying appellate court opinions, the rules of appellate procedure, the process of practicing in the courts of appeals, or being an appellate advocate. POST-TRIAL MOTIONS IN STATE COURT

Although not a prerequisite to filing an appeal, some errors can be raised in a motion for new trial filed in the trial court after conviction. If hired in a timely manner, a lawyer can file a motion for new trial. The motion for new trial must be filed no later than 30 days after the court imposes sentence.

DIRECT APPEALS

A defendant has a right to appeal a conviction and/or sentence in state and federal cases. In Texas there are two reviewing courts: the Court of Appeals (the intermediate appellate court) and the Court of Criminal Appeals (the highest court). In federal cases in Texas, there are two reviewing courts: the Fifth Circuit Court of Appeals in New Orleans, La. (the intermediate court) and the United States Supreme Court (the highest court).

In both state and federal cases there are strict time limits for filing a notice of appeal. Houston Criminal Appeal Attorney Steven J.
